Mother’s Boyfriend Convicted of Sodomy and Sexual Abuse Of Her Seven Year-Old Boy

“Based on a doctor’s expert testimony during a 2009 trial, the physical evidence was clear: a seven-year-old Anaheim boy living near Disneyland had suffered a bite to his penis and his torn rectum had bled after a bathroom encounter with his mother’s boyfriend, Miguel Angel Garcia. In addition, the boy told his mother, who’d been working during the incident, that Garcia had also given him a blow job after raping him.”

“But Juror #6 refused to hold Garcia responsible or even to deliberate the facts, according to court records.”

I wonder what juror number six had a problem with? She didn’t even want to deliberate the facts? Was she traumatized by the testimony and evidence? Was she in total denial that such things occur?

“Other jurors, who had no problem arriving at guilty verdicts at the conclusion of the trial, became frustrated by the holdout and told Superior Court Judge Carla Singer. The foreman wondered out loud if the lone juror had a mental “competency” problem. Still, the juror refused to budge. Singer ordered the panel not to quit. Several hours later–after key testimony had been reviewed, the lone juror dropped her stance and the jury reached the necessary unanimous guilty verdicts: In September 2007, 24-year-old Garcia had committed oral copulation, sexual penetration, two forcible lewd acts and sodomy on the boy.

Judge Singer responded by sentencing Garcia to 40 years to life in prison.”

    ‘I won’t lose any sleep if Garcia in fact did rape the boy.’

    ARGH! I meant I won’t lose any sleep if Garcia goes to jail for the crime he’s been convicted of.

    For me, if Garcia was raped as a child, is irrelevant when it concerns the 7 year old. Do you think he is thinking, ‘he had done to him what he did to me, so that makes it okay?”

    Yes, some offenders are abused as children, but that is no reason or excuse. If it were, I would have begun sexual assaulting those more powerless than me years ago – and I never have.

    I thought the same thing Alethea did when I read the sentence, ‘a bathroom encounter.’ No, rape.
    Yet another example of how society grossly minimizes and denies the sexual abuse of children and adolescents.

    I wonder about information not provided. Did the mother know Garcia wanted to ‘encounter’ her child sexually? Did she believe and support her child by reporting Garcia – or did she continue to allow him to stay, live, or visit them?

    In regards to Juror 6, perhaps she knew Garcia, or a friend of his. Perhaps she wanted to deny such sexual assaults and rapes even exsist. If one of the facts presented was that the bite mark matched a mold of Garcia’s teeth, maybe she was abused herself and hadn’t dealt with it and shut down emotionally. She could have been bribed to hold out. She could be a control-power hunger type. Maybe she is an offender herself, stupid, or evil. Or something we haven’t even considered. There is no excuse, but I do like to delve into the way some people’s thought processes work.

    The important thing – and KUDOS! to the judge – and likely, state law, is that Garcia was given 40 years. Hopefully, he stays in prison. I won’t lose any sleep if Garcia in fact did rape the boy.

    I don’t think it matters if Juror 6 wondered if Garcia was abused. If Garcia raped the seven-year-old boy, then he did, regardless of his history. I hold the opinion that if the above is true – and it is now considered to be due to the conviction – than Garcia’s guilty verdict was in no way ‘unfortunate.’

    So I wonder again, was Miguel “Angel” Garcia raped as a boy growing up? Probably yes. Will we ever know or find out? All we get is the end game. Perhaps juror 6 was wondering the same things. Unfortunately you must convict.
